As the Senior Planning Compliance Officer you will enforce compliance of use and development with the Colac Otway Planning Scheme, Planning and Environment Act and other relevant legislation and policies:
To proactively minimise non-compliance with Council's planning scheme and planning permit conditions through effective community education.To contribute to the preparation of policies and procedures relating to compliance actions undertaken by Council.To assist other Council compliance officers and undertake general enforcement duties as required.Key responsibilities include: Undertake activities as an Authorised Officer under the Planning and Environment Act and other related legislation which ensure compliance with that legislation, using a risk-based approach to prioritise actions taken.Investigate complaints of potential breaches of the Planning Scheme to determine the degree of non-compliance and take relevant steps to satisfactorily resolve non-compliance, taking an educative (rather than punitive) and customer focused approach.Issue Infringement Penalty Notices in accordance with established processes and procedures.Manage applications for Enforcement Orders made to the Victorian Civil and Administrative tribunal (VCAT), including representation of Council at VCAT hearings.Respond to ratepayers and members of the public in an effective, efficient and timely manner.Gather evidence, undertake research, inspections and interviews and institute formal legal proceedings on behalf of Council where necessary and as directed by the Chief Executive Officer.Preparation of hearings of the Victoria Civil and Administrative Tribunal, and the Magistrates Court, including the drafting of prosecution briefs, briefing legal representatives and consultants as required.Maintain an awareness of current legislation including planning scheme provisions.Keep and maintain an up to date register of compliance issues that includes a risk assessment of compliance activities.Liaise with compliance officers in other functions of Council including Health, Building, Local Laws, Environment and Infrastructure to ensure there is a co-ordinated multi-disciplinary approach to resolution of compliance issues.Participate in the Council's Infringements Review Committee process.About You: To support your success in this role you will have:
Experience undertaking compliance activities, preferably within Local Government.Experience in the preparation of submissions and reports and representation at legal proceedings.Demonstrated capacity to deliver outcomes using a customer focused and educative rather than punitive approach.Demonstrated ability to work independently and together with other team members.Ability to communicate effectively, manage conflict and negotiate appropriate outcomes.Computer literacy skills including understanding Geographic Information Systems, Spreadsheet database applications and Word Processing.Salary information: $84,218.68 to $90,918.88 per annum plus superannuation. Plus Commuter Use of a Council vehicle will be supplied in accordance with the current Council Light Fleet Vehicles Policy. Vehicles are provided to enable staff to fulfil operational requirements of position responsibility.
