We understand that our team are people first, employees second and facilitate hybrid working arrangements and flexible working arrangements to ensure work-life balance. For more information, please visit www.frequentis.comThe RoleWe are looking for a Commercial contracts Manager.As a key member of several project management teams, the Commercial Contracts Manager has the overall accountability for the contractual compliance, working closely with the Project Manager(s) and the Project Team(s).Their responsibility includes all customer, partner, and subcontractor contracts and relationships within a project, for the entire project lifecycle.The Commercial Contracts Manager reports to the Commercial Manager (CM). The Commercial Contracts Manager represents the external contact point and relationship manager for all contractual project matters and will support the Project and Technical leads in managing Customer expectations (scope, schedule, cost and quality). A keen negotiator, the Commercial Contracts Manager is a forward thinker in dispute avoidance and resolution, preferably with experience in litigation should that be necessary. ResponsibilitiesIn close cooperation with the PM and relevant project team members you will:Provide the legal and commercial guidance for the project in negotiations with clientsSupport the PM(s) in executing the contract (baseline plus changes)Ensure that both Parties contract obligations are interpreted, communicated to ensure contract obligations are metAssess contractual risks and opportunities, defining and implementing contractual mitigation strategiesRecord, analyse, strategize, plan and manage the negotiation of all deviations to the contract(s) obligations, their effects on resources, schedule and costsWorking with the customers commercial contract manager to prepare, approve and execute contract change orders, contract amendments and modificationsProvide guidance and training to project managers and other employees in contracting practices and proceduresExperience in negotiation and litigation, ability to understand where one course of action is preferred over anotherGood relationship builder and team playerMinimum 7 years in contract management and risk/opportunity identification (AusDefCon experience desirable)Exposure to high risk Design and Development projects (IT, mission critical SW, complex system-of-system integration) is desirableExperience with new bids and contract changesQualificationsA University qualification to the level of a Bachelor Degree or higher in law, engineering or a related disciplineExcellent knowledge of business and contractual lawWe are committed to building a workforce that reflects the diverse society in which we live and work.
