APS 6 - Employment Lawyer (Legal Stream)National Disability Insurance Agency – Newcastle NSW
The Employment and Workforce Team provides legal advice, support, and services to internal clients in respect of a broad range of human resources-related matters. The team provides a single point of contact to internal clients for human resources-related legal matters and plays a key enabling function including the identification and mitigation of legal risk for the NDIA.
The work of this fast-paced team includes the provision of advice, services and support to internal clients about a wide range of matters in relation to Australian Public Service employment. This includes APS Code of Conduct matters, work health and safety, workers' compensation and dispute resolution in external jurisdictions including the Administrative Review Tribunal, the Australian Human Rights Commission and the Fair Work Commission.
The work includes assisting with employment law disputes, including unfair dismissal and general protection claims, discrimination, sexual harassment and bullying disputes in the Fair Work Commission and Federal and State courts and tribunals.
The Employment and Workforce Team sits within the Legal Services Branch, which is the NDIA's in-house legal practice servicing the whole of the NDIA. The Employment and Workforce Team reports directly to the Deputy General Counsel.
This recruitment process will fill immediate vacancies and will develop a merit list for future opportunities that may arise over the next 18 months.
The key duties of the position include:In this role as an APS6 Lawyer you will provide leadership support to your team as well as to executives and business areas. Bring your knowledge and experience in workplace relations law, establishing and maintaining excellent working relationships with clients and other stakeholders including courts and tribunals, other government agencies, states and territories, the legal profession, and people with disability and their representatives.
Responsibilities of this role may include:
Providing or assisting senior lawyers in the provision of high quality legal advice, support, and service in respect of human resources-related matters including matters arising under:the Public Service Act 1999 and Public Service Regulations 2023 including the Australian Public Service Code of Conduct as set out in section 13 of the Public Service Act 1999the Fair Work Act 2009the Work Health and Safety Act 2011 and Work Health and Safety Regulations 2011the Safety, Rehabilitation and Compensation Act 1988the National Disability Insurance Agency Enterprise Agreement 2024 – 27Representing or supporting senior lawyers representing the NDIA in respect of human resources-related complaints and applications made to the Administrative Appeals Tribunal, Australian Human Rights Commission, Fair Work Commission, Fair Work Ombudsman, and Federal Circuit and Family Court of Australia, including unfair dismissal applications, general protections applications, and stop bullying applications.Establishing and maintaining excellent working relationships with clients and other stakeholders including courts and tribunals, other government agencies, states and territories, the legal profession, and people with disability and their representatives.Managing the priorities of clients and available resources to deliver results on time and within budget.Preparing and undertaking initial research and advice on medium level risk matters to contribute to a range of material including briefing material for Ministers, board papers, media releases, reports to Parliamentary committees, intranet and website content and correspondence.Contributing to business improvement activities, including the development of systems, processes and practical tools.EligibilitySuccessful candidates will be required to undergo a pre-employment National Police History check and provide evidence of Australian Citizenship. Failure to do so may jeopardise your offer of employment.Dependent on the role the appropriate Working with Children / Working with Vulnerable People check may be required as per State/Territory legislation. In addition to these checks, a Worker Screening Check issued by the relevant State/Territory worker screening unit will also be required for any role for which the normal duties are likely to require more than incidental contact with people with disability.The health and safety of workers, Participants and other visitors in our offices is our highest priority.NotesThis position will be offered as ongoing or non-ongoing.We intend to fill this role in an ongoing capacity, however non-ongoing roles up to 12 months with the possibility of extension up to 2 years may be offered.Should a non-ongoing position become ongoing, then a merit list established through this selection process may be used to fill the vacancy on an ongoing basis.Getting to know the National Disability Insurance AgencyThe NDIS provides funding to eligible people with disability to gain more time with family and friends, greater independence, access to new skills, jobs, or volunteering in their community, and an improved quality of life.
