APS5 Legal Adviser - Vacancy Details Overview of the Team and Role The Statutory Oversight Team sits within the Legal Group and is responsible for providing expert advice on the application of statutory processes to business areas within Comcare. We manage Comcare's risk and ad-hoc niche areas of work by liaising across all of Comcare's functions and business areas to ensure Comcare is legally compliant and achieves its stated objectives.
The team is primarily responsible for ensuring Comcare's compliance under various statutory processes including the Freedom of Information Act 1982 (FOI Act), the Public Interest Disclosure Act 2013 (PID Act), the Privacy Act 1988 , and the Ombudsman Act 1976 , and statutory reviews under the Work Health and Safety Act 2011 (WHS Act).
The Statutory Oversight team is responsible for:
Delivering Comcare's privacy function including actively promoting privacy, developing training, undertaking Privacy Impact Assessments and ensuring all Comcare activities are consistent with the Privacy Act; Managing Comcare's freedom of information function including reviews and appeals and acting as Comcare's liaison with the Office of the Australian Information Commissioner; Undertaking an integrity role including receiving Public Interest Disclosures (PID) and National Anti-Corruption Commission matters and co-ordinating PID investigations; Acting as Comcare's liaison with the Commonwealth Ombudsman and preparing responses to their enquiries and investigations; Assessing and reporting on Comcare's model litigant compliance; Undertaking oversight functions including managing escalated complaints; Managing Comcare's administrative release function. Under supervision, the Legal Adviser supports the development of client-focused legal advice and support to Comcare staff including providing privacy and FOI advice and processing complex FOI and privacy requests.
The Legal Adviser will manage risk effectively and manage their workload in a manner consistent with the APS Values and Code of Conduct, the Legal Services Directions 2017 , and internal Comcare procedures and guidelines.
Qualifications Undergraduate degree in law. Admission as a legal practitioner of the High Court or the Supreme Court of an Australian State or Territory. Current Practising Certificate or ability to obtain one within three months.
