About the NDIS Quality and Safeguards Commission The NDIS Quality and Safeguards Commission (NDIS Commission) is a regulator established on 1 July 2018 as an independent agency under section 181 A of the National Disability Insurance Scheme Act 2013 (NDIS Act) to improve the quality and safety of NDIS supports and services. The NDIS Commission is the dedicated national regulator of NDIS service providers in Australia.Are you the ideal candidate? We are looking for exceptional lawyers in the areas of commercial law or employment law to join the NDIS Commission's well regarded and highly respected legal team.As a Senior Lawyer, you will exercise a considerable degree of independence to engage in complex matters. The position requires exercising sound decision-making and judgement to produce quality and timely advice and contribute to the strategic and operational support across the NDIS Commission. An overview of responsibilities specific to each role includes but is not limited to:Senior Lawyer Commercial Drafting, negotiating and reviewing contracts including those related to the DART project. Providing advice on complex procurement, property, intellectual property, grants, commercial dispute resolution and probity issues. Supervising, mentoring and developing junior lawyers. Driving the workplace and service culture and contributing to the management of the branch. Representing the Branch in meetings with internal and external stakeholders. If required, procure and manage legal services from external legal providers in accordance with the Legal Services Directions 2017 and other requirements. Workplace Law (including providing advice on Fair Work Act 2009 (Cth) and Work Health and Safety Act 2011 (Cth), providing support in workplace investigations, and drafting or reviewing workplace policies and procedures). In conjunction with external legal providers, manage workplace matters including dispute resolution and the conduct of litigation to which the Commission is a party. Assisting General Counsel and Principal Lawyers in providing leadership, and support to other staff in the Legal Services Branch. Senior Lawyer Employment/Workplace Workplace Law (including providing advice on Fair Work Act 2009 (Cth) and Work Health and Safety Act 2011 (Cth), providing support in workplace investigations, and drafting or reviewing workplace policies and procedures). If required, procuring and managing legal services from external legal providers in accordance with the Legal Services Directions 2017 and other requirements. In conjunction with external legal providers, manage workplace matters including dispute resolution and the conduct of litigation to which the Commission is a party. In addition, candidates must demonstrate: Demonstrated ability to work well with other professional and non-professional staff, and to maintain and model a collegiate attitude. A willingness and capacity to contribute to, and advance, the Commission's strategic initiatives and objectives. High level knowledge of areas of law relevant to the Commission as an employer for the Australian Public Service and the areas of law relevant to the Commissioner's functions (including administrative law). Excellent time management, legal writing skills and attention to detail, and a demonstrated ability to set priorities, meet deadlines and work effectively under pressure. Ability to communicate clearly and effectively and work collaboratively with team members and clients. Knowledge and demonstrated application of the principles and practices of workplace diversity, workplace participation and a safe working environment. Mandatory requirements You will demonstrate the minimum mandatory requirements for the role, including: Tertiary qualifications in law; Admitted as a legal practitioner in the High Court or a Supreme Court of an Australian State or Territory; Hold, or be eligible to hold, a practicing certificate issued by the Law Society of a State or Territory; At least 5 years' post-admission experience in delivering legal services in the area of commercial law and/or employment/workplace law, working on increasingly complex matters. Additionally, NDIS Commission employees are required to be Australian Citizens. Candidates employed by the NDIS Commission are required to undertake a Police Records Check prior to commencement of employment. If the position involves working with children and/or vulnerable people, the appropriate check for this will also be required to be undertaken. Should business need arise, be willing to obtain and maintain a Negative Vetting Level 1 or Negative Vetting Level 2 security clearance.
