Senior Executive Service Band 1 - General Counsel - Commercial The Department of Defence is seeking an enthusiastic senior executive to fill the position Assistant Secretary General Counsel – Commercial.
As part of the Senior Leadership Group, you will play a key role in promoting and influencing a shared commitment to the strategic direction of Defence, as most recently detailed in the National Defence: Defence Strategic Review 2023 . You will:
Lead and manage a branch practicing inclusive leadership, collaboration and integrity; Demonstrate strong judgement and capitalise on innovative alternatives to resolve complex problems; Effectively challenge the status quo when required; Demonstrate resilience and personal accountability for the quality of advice and delivery of results; and Demonstrate exceptional communication skills, both written and verbal. The ideal candidate will be a collaborative leader, exemplify the Defence Values and Behaviours , and engender a culture of innovation and agility. They will be self-aware, positive in considering and respecting a diversity of ideas and perspectives of others. They will demonstrate the capability to provide timely and accurate advice to senior leaders and Government on complex matters. They will have outstanding judgement, strategic awareness, and parliamentary and media acumen.
As part of this selection process, a Merit Pool of highly suitable candidates will be established to fill current vacancies and any similar vacancies that may arise over the next 18 months.
The Department of Defence's primary role is to defend Australia and its national interests. In delivering Defence capability to the Australian Government, the Defence Associate Secretary Group (ASG) is seeking a highly qualified and experienced legal practitioner to fill the position of General Counsel - Commercial
The General Counsel - Commercial will provide strategic legal advice to the ASG Senior Leadership Group and Defence more broadly on legal aspects of complex contracting and procurement matters and will help to ensure better identification and management of ASG and Defence's commercial legal risk. The General Counsel - Commercial will also have remit for the delivery of all of Defence's in-house commercial legal function and will lead the Commercial Law Team in Defence Legal.
The General Counsel - Commercial will manage the use of ASG external legal resources (who provide the majority of legal services to ASG) and will help to better ensure the optimal delivery of legal resources to ASG. The combined team that the General Counsel - Commercial will lead will be approximately 20 to 25 lawyers.
The role is required to have good knowledge, skills and advanced professional expertise as a senior legal practitioner, as well as experience in the application of law in a commercial setting. An understanding of the relevant environmental factors affecting Defence, the relationship between complex issues and a sound grasp of Commonwealth frameworks, such as procurement, financial, employment and security, are all important. The occupant of the role must have high level relationship management, influencing and negotiation skills, with strong leadership ability.
