The Role
Reporting to the Assistant Director, the Compliance Officers are responsible for ensuring child care sector compliance with the Family Assistance Law through compliance investigations and contributing to the Financial Integrity Strategy outcomes.
The department has available positions in our Compliance Operations Team and our Provider Audits Team. The Compliance Operations Team supports the integrity of the child care system through monitoring, early intervention, and sanction of child care providers that do not comply with the Family Assistance Law. Compliance Officers contribute to or undertake site visits, campaigns and targeted operations, and regulatory monitoring and investigations. 
Compliance monitoring is risk based, and when non-compliance is identified proportionate regulatory responses are taken. The team may issue and pursue debts, take administrative action, issue infringement notices, apply sanctions such as suspension or cancellation of approvals, commence civil penalty proceedings or refer matters for criminal prosecution.
Provider Audits perform similar functions to Compliance Operations with a focus on the financial auditing of relevant obligations under the Family Assistance Law.
Duties and Responsibilities
Responsibilities of the APS Level 6 Senior Compliance Officer may include:

Research, interpret, maintain knowledge of and apply legislation and policy and ensure decisions comply with relevant Acts, delegations and authorisations, departmental policies and the Australian Government Investigation Standards Undertake and coordinate high-risk case-based investigations, analyse data and evidence to identify non-compliance, gather evidence and conduct monitoring visits and warrants, prepare decisions and recommendations for enforcement action including infringement notices, sanctions or prosecution  Apply comprehensive work knowledge, precedent and established legislation, policy, procedures and guidelines to situations involving complexity and sensitivity which require considerable interpretation and analysis Analyse data and information to identify risk and threat of alleged non-compliance or trends to inform recommendations and delegate decision making relating to compliance investigations and audits Undertake monitoring visits and meet with providers and/or third parties as required to support the monitoring process, verify compliance, and assess risk to the Child Care Subsidy program Provide advice on regulatory issues, including compliance with the Family Assistance Law, investigations, enforcement activity, risk assessments and best practice  Engage with internal and external stakeholders, including state and territory regulatory bodies to facilitate joint monitoring activities, including sharing information and monitoring visits  Undertake preparation of a range of documents including briefs for Minister's and senior executives, reports, guidelines and standard operating procedures Provide support to the leadership team, supervise and mentor geographically dispersed operational staff undertaking investigations, audits, enforcement action and applying legislation Actively engage in the development, implementation, and continuous improvement of systems to support the strategic direction of the branch Undertaking regional and interstate travel Represent the department by attending court or tribunals as a witness, and support preparation of litigation documents for cases referred to court or Administrative Appeals Tribunal. Eligibility
