A new role awaits. The Dispute Resolution & Litigation (DR&L) branch in the Chief Counsel Division is a growing in-house legal practice servicing the NDIA with legal advice and litigation support services on merits review matters for participants in the Administrative Appeals Tribunal (Tribunal), soon to be known as the Administrative Review Tribunal.
The DR&L branch is responsible for providing trusted high-quality legal advice and litigation support services to respond to these applications by NDIS participants and prospective participants. The branch provides strategic oversight of legal risk across the Agency's AAT program, as well as supporting continuous improvement of decision-making to improve outcomes under the NDIS.
The key duties of the position include:Where you can add value. You will have responsibility to resolve issues and risks across wide-ranging activities of substantial depth involving significant detail.
The EL2 Lawyer will exercise a significant degree of independence and will use a high-level of decision-making and judgement. The role will be required to coordinate and assume responsibility for the provision of high-quality legal advice, support, and services in relation to alternate dispute resolution and advocacy services in the Tribunal. This may include management of appeals to the Federal Court.
You will have autonomy to manage the day-to-day operations and strategic direction of the team. You will act as mentor and coach to ensure legal advice, support, and service delivery meets or exceeds agreed service levels with business areas across the NDIA.
Responsibilities of these roles include, but are not limited to:
Providing high-quality legal advice, support, and services to internal clients in the management and resolution of participant-related reviews in the Tribunal.Leading a team of lawyers managing Tribunal matters, both in-house and as instructors to external firms, including oversight of all legal aspects of AAT cases, workflow prioritisation, and mentoring to provide support in legal matters.Enough about us, let's talk about youThe successful candidate will possess excellent technical legal skills and demonstrated experience in leading legal teams to deliver high-value outcomes for the Agency. You will demonstrate experience in, or knowledge of, some or all of the following:
Administrative law and principles of good administrative decision-makingAlternative dispute resolution, mediation, and/or conflict resolutionLitigation, including in Commonwealth or state/territory courts and tribunalsStatutory interpretation, particularly in relation to the NDIS Act and National Disability Insurance Scheme (Supports for Participants) Rules 2013.You will act inclusively, and with integrity, empathy, and respect when working with the team, participants, and prospective participants, as well as external stakeholders.
This position is within the legal job stream, and the candidate must possess relevant academic qualifications with admission as a legal practitioner, however described, of the High Court or the Supreme Court of an Australian State or Territory and hold or have the ability to immediately obtain a current practising certificate as an unsupervised lawyer.
EligibilitySuccessful candidates will be required to undergo a pre-employment National Police History check and provide evidence of Australian Citizenship. Failure to do so may jeopardise your offer of employment.Dependent on the role, the appropriate Working with Children / Working with Vulnerable People check may be required as per State/Territory legislation.
