Magistrate of the Magistrates Court of the Australian Capital Territory Skip to content The Attorney-General of the Australian Capital Territory, Mr Shane Rattenbury MLA, invites expressions of interest from eligible and suitably qualified people for appointment as a Magistrate to the Magistrates Court of the Australian Capital Territory. The Magistrates Court of the Australian Capital Territory has wide jurisdiction under the Magistrates Court Act 1930 and other legislation, including with respect to adult and children's criminal matters, care and protection, civil matters including family and personal protection orders and commercial leases, industrial criminal and civil matters, and coronial inquests.
The Magistrate will exercise the functions of a Magistrate of the Magistrates Court of the Australian Capital Territory, as arranged by the Chief Magistrate.
Magistrates are not permitted to undertake other employment, except with the written consent of the Attorney General.

Expressions of interest are sought from all areas of the legal community including the private sector, government and community sector.

This expression of interest process may also be used to establish an order of merit to support future appointments as Magistrate over the next 12 months.

Magistrates are appointed under the Magistrates Court Act 1930 , by the ACT Executive, following consultation with the Chief Magistrate.
A person is eligible to be appointed as a Magistrate if they have been a lawyer for at least five years and if they are under the age of seventy years.
The selection criteria for appointment as a Magistrate is outlined in the Magistrates Court (Magistrates Appointment Requirements) Determination 2009 and can be found on the ACT Legislation Register Remuneration, allowances and entitlements are set independently by the ACT Remuneration Tribunal.
