Our client is a leading boutique Australian financing & securitized lending platform.
Their operations encompass a diverse range of commercial lending solutions.
They provide securitized loans of up to $10m to investors, non-residents, SMSFs, property developers and commercial business clients.
As part of the Senior Leadership Team, you will work with a group of highly motivated individuals and report into the Executive Chair.
We are seeking an experienced and dynamic General Counsel to oversee all legal and regulatory matters within the group.
A key aspect of the role will be litigation management with additional responsibilities around lending transactional matters and regulatory compliance.
The ideal person will have experience in financial services and lending as well as a demonstrable history in litigation and/or insolvency law.
Responsibilities:
Litigation management : work to engage with external firms to manage files efficiently through recovery action including attending mediation, arbitration & trials.
Manage recovery work for caveat files as well as management of AFCA cases.
Transactional matters : Review loan documentation work prepared by external firms as well as investigation of transactional matters as loans move through their life cycle to settlement.
Compliance : Operate a calendar of compliance requirements with a focus on compliant growth and continuous improvement.
Group legal issues : Manage external law firm providers across trademarks, law changes as well as supplier and aggregator agreements.
Your background:
Relevant qualification in Law and a current practicing certificate Experience managing loan and security documents in a business lending environment Legal experience across the regulatory framework for commercial lending in Australia including ASIC, Corporations Act, NCCP, Banking Code of Practice Excellent leadership, communication, and interpersonal skills.
Strong analytical and problem-solving abilities.
