The commission is responsible for undertaking investigations into allegations of unfair trade practices involving goods entering Australia and administering Australia's anti-dumping legislation. These investigations seek to deliver a level playing field for industry. Professionalism, excellence and independence underpins the commission's world-class reputation.The commission is led by the Anti-Dumping Commissioner (Commissioner), who is an independent statutory office holder. The commission is staffed by employees from the department made available to the Commissioner, including lawyers to provide specialist legal services. There are three branches in the commission: Investigations, Strategy and Operations and Legal.The Executive Director, Legal (EDL) leads the Legal Branch, which is made up of a specialist legal service team with expertise in administrative and trade remedies law. The EDL will have two direct reports (Directors/Principal Legal Counsel).The team provides high quality, client focussed legal services to investigations teams and the policy team. The EDL will report directly to the Commissioner, providing specialist legal advice and briefings to the commission and Commissioner (as a decision maker) to support good decision making and promote best-practice regulation. They will prioritise workflows to meet legislative deadlines and collaborate across the commission and will manage the commission's role in merits review proceedings by the Anti-Dumping Review Panel, judicial review proceedings and World Trade Organisation matters and compliance issues.The EDL is also accountable to the Chief Counsel within the Department of Industry, Science and Resources in respect of compliance with professional standards and the Legal Services Directions, and escalating matters of legal risk as appropriate, and may seek support from the Chief Counsel in relation to those matters and other legal professional obligations.The Commission is committed to delivering a positive, flexible and inclusive workplace. We are looking for motivated candidates who have:A minimum of 7 years post admission experience.A strong understanding of administrative law and statutory interpretation principles.Highly developed collaboration skills, including the ability to negotiate, liaise and influence colleagues and stakeholders.High standards of professional and personal integrity.Sound knowledge of Australia's anti-dumping legislation (Part XVB of the Customs Act 1901) and World Trade Organization (WTO) obligations under the Anti-Dumping Agreement and the Agreement on Subsidies and Countervailing Measure.A strong track record of managing and leading high performing teams to deliver against competing priorities.Experience providing advice in a domestic system that operates within international treaty arrangements, particularly WTO treaties, is ideal but not required.Well-developed leadership, planning and organisational skills.If you are eager to make a positive impact and have the skills, experience and motivation to succeed in this role, we would welcome your application.What you will doLeading the Legal Branch, responsibilities may include:Managing the team to draft high quality advice and documents (including advices on cases, practice instructions, briefs, talking points, ministerial submissions, corporate and public reporting).Using effective stakeholder/client management skills to support the team to deliver advice within the commission's investigations and decision-making frameworks.Overseeing development of the commission's written and oral submissions in merits and judicial review.Leading the Commission's engagement with the Department of Foreign Affairs and Trade (DFAT) and WTO stakeholders and input into WTO disputes and compliance matters.Representing the Commission in domestic and international fora.Working closely with the policy section to provide effective legal advice to Commission investigators to address outcomes of domestic reviews and WTO cases.Supporting the Commission's strategic engagement across Government and internationally on trade remedies issues.Other duties as required from time to time to support the work and priorities of the commission.Must have at least a Bachelor of Laws degree (or equivalent) from a recognised Australian tertiary education provider and hold an unrestricted practicing certificate.Admission as a legal practitioner of the High Court or the Supreme Court of a State or Territory of Australia.Substantial contemporary, relevant knowledge and experience in relevant areas of law including World Trade Organization Agreements, international trade remedies law, and/or Australian anti-dumping legislation.To be eligible for employment in the APS and the department, candidates must be Australian Citizens.Positions require a Negative Vetting 1 security clearance and successful candidates will be required to obtain and maintain a clearance at this level.NotesAn Individual Flexibility Arrangement may be negotiated for the additional duties in this role and be commensurate with the skills and experience of the applicant (noting the Principal Legal Counsel salary range is $142,009-$151,937).A merit pool may be established and used to fill future vacancies within 18 months from the date the vacancy was first advertised in the Gazette.The department does currently offer flexible work opportunities for many roles. This vacancy can be Canberra or Melbourne based, although flexible or remote work arrangements may be considered.
