The Tribunal seeks applicants who are experienced lawyers with a strong understanding of legal principles and procedures.The successful applicant will have a sound knowledge of the Criminal Law (Mental Impairment) Act 2023 (WA) and be able to interpret and apply its provisions. They will also be skilled in conducting hearings, making decisions, and providing reports as required.About the Role:The Mental Impairment Review Tribunal's primary function is to administer Custody Orders and Supervision Orders for Supervised Persons. The Tribunal convenes approximately once to twice per week, with an increase in hearings developing over time.The composition of the Tribunal will vary depending on the type of hearings being conducted. Members include a President, Deputy Presidents, Community Members, Psychiatrists, Psychologists, and representatives from the Department of Justice and the Department of Communities.Benefits and Opportunities:Tribunal appointments are made by the Minister upon endorsement by Cabinet. Specific terms are limited to 5 years prior to consideration of reappointment by the Attorney General. Deputy Presidents are appointed on a sessional basis and paid $619 per hearing, including meeting reading, preparation, and presiding at the hearing itself.About the Mental Impairment Review Tribunal:The Tribunal replaced the Mentally Impaired Accused Review Board and is established under section 156 of the Act. It is governed by the provisions contained within it.The Act expands disposition options available to the judiciary, limits custody orders to align with likely sentences, and introduces procedural fairness provisions.Application Process:Please review the attached Position Description for further information about the requirements of the position.
