Your journey with ATCO Australia ATCO is looking for a mid-level Legal Counsel ideally with experience in the Construction, Utilities and/or Energy (particularly in renewables) sectors based in our Mill Street, Perth office. The position will be full-time (part-time considered) for an initial 12-month fixed-term to support the delivery of strategic projects, with the possibility of becoming permanent subject to business requirements.
Reporting to the Senior Legal Counsel & Assistant Company Secretary, you will be joining an established in-house legal team which is highly regarded by the business, under the leadership of an experienced General Counsel and senior legal team, in a flexible and friendly working environment.
What you will do Front-end construction support, to assist with timely, pragmatic and risk balanced advice to achieve desired commercial outcomes, drafting and amending project documents, and assisting in identifying and mitigating risks. Back-end construction support, assisting the project teams with key contract management advice and claims/disputes (expert determination, adjudication, arbitration, mediation, and in court), including defects, delays, and payment. Preparing, reviewing, negotiating and finalizing commercial contracts with reference to ATCO's methods of business, contractual relations and regulatory/legislative requirements. Working with business development teams on new projects including assisting with commercial contracts and general legal advice. Implementing contract management systems and ensuring that the relevant protocols are followed in relation to the contract life cycle. Reviewing and providing specialist advice or expertise associated with the contracting processes and commercially acceptable outcomes. Reviewing and assessing risk in contractual arrangements and maintaining contract review processes. Providing legal advice to ATCO's Australian entities on a broad range of issues including general commercial, corporate, dispute resolution, procurement, gas and energy legislation. Ensuring that appropriate risk analysis is conducted, and any identified risks are managed, monitored and addressed. What you will bring Construction/Projects experience. Minimum 5-7 years PQE. University degree qualification in Law coupled with admission or eligibility for immediate admission to practice in WA – must hold or be entitled to hold an unrestricted practising certificate in WA. Considerable legal experience, knowledge and application of legal principles in operation, commercial and/or regulatory requirements. Experience in the energy sector and practical commercial experience would be advantageous. Interest or experience with large projects and construction will be well regarded. Self-starter, with ability to work autonomously with a wide range of stakeholders. Ability to work interoffice with some intermittent travel a possibility. Why ATCO Australia? Always there. Anywhere.
