The Department is responsible for the design and implementation of the Australian Government's infrastructure, transport and regional development policies and programs, and is the lead agency for communications and the arts. We are at the forefront of the Australian Government’s efforts to connect our communities, secure the nation’s economic future, improve living standards, provide access to high quality communication services and ensure all Australians can enjoy diverse artistic and cultural experiences.
The Department has two Legal Services branches: one providing legal support to the infrastructure, transport and regional development functions of the Department; and the other to the communications and the arts functions. The advertised opportunities are in the Legal Services Branch – Infrastructure, Transport and Regional Development, which is headed up by the General Counsel (who is an outposted AGS Senior General Counsel) and the General Counsel – Commercial, and will consist of 3 sections (Government Law, Commercial Law and Major Projects), each headed up by a Principal Lawyer.

We have two opportunities at the principal lawyer (EL2) level.
Principal Lawyer, Major Projects
This is a new role that has been established to provide legal support, working closely with the General Counsel – Commercial, for significant projects in which the department has a role, including the construction of major infrastructure such as Western Sydney Airport, and the Western Sydney City Deal, Inland Rail, Moorebank Intermodal Terminal and WestConnex, as well as major and varied projects in the Territories. The occupant of this role will be responsible for a team of 2 to 3 lawyers and will also manage services from external legal firms. The role will involve:
advising on contract law, property law and environmental and planning law matters;

drafting agreements, such as design and constructions contracts, services agreements and licensing agreements;

providing general legal support for complex infrastructure projects – including to ensure the Department complies with its obligations and appropriately exercises its rights in relation to such projects;

advising on procurements, grants, intellectual property and other commercial matters.

Principal Lawyer, Government Law
The occupant of this role will be responsible for a team of 2 to 3 lawyers, working closely with the General Counsel. The Government Law team is responsible for all aspects of non-commercial legal services for relevant areas of the department—particular areas of focus include the regulation of airports, road vehicles and shipping; the administration of non-self-governing territories; and authority for Commonwealth spending. The team also manages litigation for relevant areas of the department, including coronials, judicial and merits review and civil litigation. The Principal Lawyer, Government Law, will be expected to:
provide advice on administrative law and statutory interpretation of complex legislation administered by the Department;

draft legislative and other statutory instruments;

provide legal advice to support legislative projects;

manage and conduct litigation and dispute resolution, including, where appropriate, representing the Department before the AAT;

advise on other legal obligations (e.g. tort, defamation, corporate constitutions and other issues as they arise).

Eligibility

Employment with the Department of Infrastructure, Transport, Regional Development and Communications is subject to conditions prescribed within the Public Service Act 1999 including:
Citizenship: To be eligible for employment with the Department of Infrastructure, Transport, Regional Development and Communications, applicants must be an Australian citizen. Only in exceptional circumstances will the department consider waiving this requirement.
Health Assessment: The preferred applicant may be required to undergo a medical examination conducted by the department’s preferred medical provider.
Security Clearance: The successful candidate must be able to obtain and/or maintain a security clearance at the Baseline Level. You must be willing to disclose all relevant and required information. You must have lived in Australia, or have a checkable background, for at least the preceding five years for Baseline Vetting clearances. More information on the security clearance vetting process is available on the Australian Government Security Vetting Agency (AGSVA) website.
Qualifications: Tertiary degree in law from an Australian tertiary institution, or a comparable overseas qualification which is appropriate to the duties of the position; andAdmission as a legal practitioner, however described, of the High Court or of the Supreme Court of an Australian State or Territory or be eligible for admission.
