Position Purpose
Reporting to the Chief Financial Officer (CFO), the Commercial and Contracts Manager will develop and execute business unit strategies for reducing WesTrac’s commercial exposure and maximizing the financial opportunities available to WesTrac.
The role is accountable for overseeing the commercial negotiations and execution of all sales contractual agreements across Western Australia with ad hoc provision of Commercial and Contracts support to New South Wales operations as required by the business.
The position is responsible for the establishment and implementation of processes and systems in the Business Unit to ensure contracts are appropriately managed and remain suitably governed and compliant, resulting in optimal commercial outcomes for the business.
This role will provide leadership and guidance to the Commercial and Contracts Team providing appropriate direction to key stakeholders.
Role accountabilities include; but not limited to:
Provide Commercial and Contracts leadership, direction, advice and support to teams as required
Encourage collaboration across the business to share best practise and create efficiencies.
Provide commercial support, to internal and external stakeholders on all sales contract matters
Act as the SME for MARC contracts and all related matters
Manage the contracts team to deliver day to day commercial support to internal stakeholders
Provide a central point of contact for claims, commercial and contractual notices
Promote and support contractual compliance through engagement with responsible teams within WesTrac, where appropriate liaise with Customer’s and/or Caterpillar

Education/Certificates

Essential:
Tertiary qualification within either of the following disciplines; Engineering, Commercial or Business , coupled with at least 10 years’ experience within a Contract Management position within a similar industry or, with demonstrable experience in the establishment and execution of contracts worth in excess of 100 million dollars
A minimum of 5 years people management experience with the ability to inspire and motivate others
Excellent organisation skills, with the ability to manage fluctuating workloads and conflicting priorities to achieve tight deadlines
Advanced communication skills – written, verbal and interpersonal
Highly developed facilitation and presentation skills, with the ability to influence and engage with various audiences
High level of initiative and problem solving skills with the ability to follow through with required actions
Excellent attention to detail with the ability to draft contractual agreements, produce reports, analyse data and provide appropriate recommendations for actioning
Advanced computer literacy (Microsoft Office Suite)
Ability to work successfully within a team and autonomously actions

Desirable:
Post Graduate qualification within business/commercial field (e.g. Master of Business Administration)
